Last updated: 30 October 2026 · Version 1.0.1
Web version: https://movena.pro/terms
1. Scope and provider
1.1 These Terms of Use govern your use of the Movena AI iOS app (the "App"), provided by Expertive OÜ, Ruunaoja tn 3, 11415 Tallinn, Estonia, registry code 16734170 ("we", "us").
1.2 By creating an account or using the App, you agree to these terms. Our Privacy Policy (https://movena.pro/privacy) explains how we process personal data.
2. What Movena AI is – and what it is not
2.1 Movena AI offers camera-based movement practice for general fitness and wellness. The App uses on-device analysis to count repetitions and give exercise form feedback for general fitness.
2.2 Movena AI is not a medical device. It is not physiotherapy and does not provide medical advice, diagnosis, treatment, prevention or monitoring of any disease or physical condition. The App does not replace a doctor, physiotherapist or other qualified professional.
2.3 Feedback in the App is automated, may be inaccurate, and depends on lighting, camera position and your device. Do not rely on it for health decisions.
3. Your safety
3.1 Exercise at your own pace and within your own limits. Make sure you have enough free space and a stable, safe surface.
3.2 Stop immediately if you feel pain, dizziness, shortness of breath or discomfort.
3.3 If you have any health condition, are pregnant, or are unsure whether an exercise is suitable for you, consult a doctor before using the App.
3.4 Easy modes offer smaller ranges of movement for a gentler workout. They are a fitness setting, not a medical adaptation.
4. Eligibility: 18+
You must be at least 18 years old to use the App. By using the App, you confirm that you are 18 or older.
5. Account
5.1 You can sign in with Sign in with Apple or with your email address. Keep your login details confidential; you are responsible for activity under your account unless you are not at fault.
5.2 You can request deletion of your account at any time by emailing [email protected] or via Contact support in the App; an in-app deletion control will be provided as soon as it is available. Deleting your account does not cancel an active subscription (see section 7).
6. Licence
6.1 Subject to these terms, we grant you a non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes on Apple devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
6.2 You may not copy, modify, decompile or reverse-engineer the App, except as permitted by mandatory law, misuse it, circumvent technical protections or subscription checks, or use it in breach of applicable law.
7. Movena Pro subscription and free trial
7.1 Some features require Movena Pro, an auto-renewable subscription with a monthly billing period, purchased through Apple's App Store. The price is shown in the App and in the App Store before purchase, in your local currency, including applicable taxes.
7.2 Free trial: Eligible new subscribers may receive a one-month free introductory trial. A valid payment method in your Apple ID is required. Unless you cancel at least 24 hours before the end of the trial, the subscription converts automatically into a paid monthly subscription and your Apple ID account is charged within 24 hours before the end of the trial.
7.3 Automatic renewal: Payment is charged to your Apple ID account on confirmation of purchase. The subscription renews automatically for another month at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
7.4 Manage and cancel: You can manage your subscription and turn off auto-renewal at any time in your Apple ID account settings (Settings → your name → Subscriptions) after purchase. Cancellation takes effect at the end of the current billing period. If you cancel during the free trial, any unused portion of the trial is forfeited when the cancellation takes effect.
7.5 Payments and refunds are processed exclusively by Apple under Apple's terms. We cannot issue refunds ourselves; refund requests must be made to Apple (https://reportaproblem.apple.com). Your statutory rights, including any right of withdrawal as handled by Apple, remain unaffected.
7.6 We will inform you in advance of price changes in line with Apple's rules; where required, Apple will ask for your consent.
8. Apple
8.1 These terms are concluded between you and us only, not with Apple Inc. or its affiliates ("Apple"). We, not Apple, are solely responsible for the App (the "Licensed Application") and its content.
8.2 Apple has no obligation to provide maintenance or support for the App. To the extent permitted by law, Apple has no warranty obligation with respect to the App; if the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any.
8.3 Apple is not responsible for addressing any claims by you or a third party relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and consumer protection or similar claims. We, not Apple, are responsible for investigating, defending and settling any claim that the App infringes third-party intellectual property rights.
8.4 You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8.5 Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Where these terms conflict with Apple's Licensed Application End User License Agreement, the more consumer-friendly provision applies, provided that sections 8.1 to 8.5 always apply.
9. Availability and changes to the App
We continuously develop the App. We may change features for a valid reason (e.g. technical development, security, legal requirements). If a change impairs your use more than insignificantly, we will inform you in advance; you can then cancel your subscription. Temporary interruptions for maintenance or for reasons beyond our control are possible. Statutory rights in respect of digital content and services remain unaffected.
10. Term and termination
10.1 You can stop using the App and delete your account at any time.
10.2 We may suspend or terminate your access for good cause, in particular for serious or repeated breach of these terms or misuse. Where reasonable, we will warn you first. Statutory termination rights remain unaffected.
11. Liability
11.1 We are liable without limitation for intent and gross negligence; for injury to life, body or health caused by our fault; under mandatory product liability law; and where we have given a guarantee.
11.2 For slight negligence, we are liable only for breach of an essential obligation, that is, an obligation that makes proper performance of the contract possible in the first place and on which you may regularly rely. In that case our liability is limited to the foreseeable damage typical for this type of contract.
11.3 Otherwise, our liability is excluded to the extent permitted by law. Statutory rights in case of lack of conformity of digital content or services remain unaffected. These rules also apply to the personal liability of our representatives and agents.
12. Changes to these terms
12.1 We may change these terms for a valid reason, such as legal changes, new features or to prevent misuse. We will inform you of material changes in the App at least 30 days before they take effect.
12.2 If a change materially affects your rights, we will ask for your consent in the App. If you do not agree, you can cancel your subscription and delete your account.
13. Governing law, jurisdiction, contact
13.1 These terms are governed by Estonian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer with your habitual residence in another country (for example Germany or Austria), you keep the protection of the mandatory provisions of the law of that country (Art. 6(2) Rome I Regulation).
13.2 As a consumer, you can bring proceedings in the courts of your country of residence, and you can only be sued there (Art. 18 Brussels Ia Regulation). For business customers, Harju County Court (Harju Maakohus), Tallinn, has jurisdiction.
13.3 If a provision of these terms is invalid, the remaining provisions stay effective.
